Terms and Conditions

Welcome to the YMCA Nelson Mandela Bay website, including the Y-Stay booking platform (“Experience Y-Stay: Your Home Away from Home”). By accessing or using this website at www.ymcanmb.org, you agree to be bound by the following terms and conditions, which govern your use of the site, Y-Stay accommodation services, and participation in YMCA Nelson Mandela Bay’s community and youth empowerment programmes. These terms comply with South African laws, including the Consumer Protection Act No. 68 of 2008 (CPA), the Electronic Communications and Transactions Act No. 25 of 2002 (ECTA), and the Protection of Personal Information Act No. 4 of 2013 (POPIA). If you do not agree with these terms, please refrain from using the website.

1. Definitions

- “YMCA NMB” refers to YMCA Nelson Mandela Bay, a registered non-profit Organisation.
- “Website” refers to the YMCA Nelson Mandela Bay website, including the Y-Stay booking platform.
- “User” or “You” refers to any individual or entity accessing or using the website, booking accommodations, or engaging with YMCA programmes.
- “Services” include accommodation bookings, inquiries, and participation in YMCA programmes.
- “YMCA Programmes” include youth leadership workshops, educational support initiatives, recreational activities, and community outreach events organised by YMCA NMB.

2. Use of the Website

The YMCA Nelson Mandela Bay website serves as a platform to facilitate Y-Stay accommodation bookings (Single Room, Twin Room, Dormitory, Conference Room), provide information about YMCA NMB’s community and youth empowerment programmes, and promote the Organisation’s mission of fostering social responsibility and inclusion. Users can access details about Y-Stay accommodations, submit booking inquiries, and explore opportunities to participate in YMCA programmes, including youth leadership workshops, educational support, and community events. Users must be at least 18 years old or have a legal guardian's consent to engage with the website’s services or programmes. You agree to use the website lawfully, ethically, and responsibly, in compliance with the CPA for fair business practices and ECTA for secure electronic transactions. Prohibited activities include hacking, unauthorised data collection, posting harmful or defamatory content, misrepresenting identity, or any actions that disrupt the website’s functionality or compromise its security. YMCA NMB reserves the right to suspend or terminate access for Users violating these terms, with potential legal action under ECTA’s cybercrime provisions or other applicable South African laws. 3. Booking Process

Booking inquiries for Y-Stay accommodations can be made via email (bookings@ymcanmb.org), phone (+27 41 023 0266), or WhatsApp (+27 71 063 3775). Users must provide details of their preferred accommodation, dates, the number of guests, and their payment method. Per Section 43 of the CPA, all booking terms, including rates starting from (e.g., Single Room: R245 per night; Dormitory: R175 adult, R155 teen, R135 child, excluding meals), check-in (2:00 PM), and check-out (10:00 AM) times, are disclosed on the website. Bookings are confirmed only upon receipt of official payment confirmation, and YMCA NMB will respond within 48 hours to finalise arrangements. Cancellations or modifications are subject to YMCA NMB’s policy, available upon request.

4. Payment and Pricing

All prices are quoted in South African Rand (ZAR) and exclude meals unless otherwise stated. Payments must be made as per the instructions provided during the booking process. YMCA NMB ensures pricing transparency in line with Section 23 of the CPA. We reserve the right to adjust prices due to unforeseen circumstances, with prior notice to Users as required by law. Refunds, if applicable, will be processed by YMCA NMB’s cancellation

policy and Section 56 of the CPA, which provides for consumer rights to refunds under certain conditions.

5. Intellectual Property

All content, including text, graphics, logos, and the Y-Stay slogan “Safe, Affordable & Purpose Driven,” is protected under the Copyright Act No. 98 of 1978 (as amended). Users may view or download content for personal, non-commercial use, provided copyright notices remain intact. Unauthorized reproduction or commercial use is prohibited and may result in legal action. For permission requests, contact info@ymcanmb.org

6. Data Protection

YMCA NMB complies with POPIA in processing personal information (e.g., name, email, phone number) provided during booking inquiries or program registrations. Data is collected solely for processing bookings or facilitating program participation and will not be shared with third parties without consent, except as required by law. Users have the right to access, correct, or request the deletion of their data under POPIA. For data-related inquiries, contact info@ymcanmb.org. Per Section 26 of ECTA, we ensure the security of electronic transactions and data integrity.

7. Limitation of Liability

YMCA NMB strives to provide accurate and reliable information on the website, but does not guarantee its completeness or availability. To the extent permitted by the CPA, YMCA NMB is not liable for any direct, indirect, or consequential losses arising from website use, booking errors, service disruptions, or participation in YMCA programmes, except in cases of gross negligence or wilful misconduct. Users acknowledge that accommodation services and program activities (e.g., youth workshops, community events) are subject to availability, external factors (e.g., weather, maintenance), or specific eligibility criteria, as disclosed under Section 49 of the CPA.

8. Code of Conduct

Guests at Y-Stay and participants in YMCA programmes (e.g., youth leadership workshops, educational initiatives, community outreach) must adhere to YMCA NMB’s code of conduct. This includes respecting non-mixed dormitory policies, facility rules (e.g., braai area, TV room), and program guidelines to ensure a safe, inclusive environment aligned with the Organisation’s mission. Disruptive behaviour, non-compliance with program rules, or damage to facilities may result in removal from the premises or program without refund, as permitted under the CPA for breach of agreed terms. Program-specific codes of conduct will be communicated to participants upon registration.

9. Dispute Resolution

Any disputes arising from these terms, website use, bookings, or program participation will be resolved through negotiation or mediation, as encouraged by Section 69 of the CPA. If unresolved, disputes may be referred to the National Consumer Commission or a South African court with jurisdiction. Users may contact YMCA NMB at info@ymcanmb.org for assistance.

10. Amendments

YMCA NMB reserves the right to update these terms without prior notice, with changes effective upon posting. Continued use of the website or participation in programmes constitutes acceptance of the revised terms, as permitted under Section 22 of ECTA.
